Can they shut me off in New York?

Short answer · Cold weather protections (HEFPA) · November 1 – April 15

From November 1 through April 15, New York utilities must take extra steps before shutting off heat-related service. They must try to contact you at least 72 hours before and on the day of shutoff. If someone in the home would likely suffer serious harm to health or safety, the utility must refer you to local social services and keep service on for 15 business days.

Who is protected

Residential customers with heat-related gas, electric or steam service, under the Home Energy Fair Practices Act (HEFPA).

What to do in the next 48 hours

  1. Tell the utility if anyone in the home is elderly, disabled, ill or very young.
  2. Ask for a deferred payment agreement. HEFPA gives you the right to one.
  3. Apply for HEAP and Emergency HEAP through your local Department of Social Services.
  4. Still stuck? Contact the New York State Department of Public Service (free).
